Terms of Service

These Terms of Service ("Terms") govern your use of Eviory OS. Digital products may be purchased directly through our platform or via third-party storefronts (e.g., Payhip, Gumroad, Etsy). Payments may be processed by third-party payment processors, including Dodo Payments, whose own terms and privacy policies also apply to your transaction.

Eviory Pro and Pro+ subscriptions include Managed AI Credits, a monthly quota of AI usage powered and billed by Eviory, requiring no configuration on your part. Pro includes 1,000 Managed AI Credits per month, a taste of the Managed AI experience; for daily AI-assisted workflows, Pro+ offers a significantly larger monthly quota (currently 20,000 credits, subject to any limited-time promotional allocation communicated separately). Once your monthly Managed AI Credits are exhausted, you may continue using AI features by connecting your own API key via Bring Your Own Key (BYOK), or by purchasing an AI Credits Top-Up. Free tier users must use BYOK to access AI features, as no Managed AI Credits are included. If you utilize BYOK, you are fully responsible for any and all costs incurred directly with your third-party AI provider. Eviory assumes no liability for API usage limits, billing, or service interruptions arising from your personal API keys. Your API key is stored locally on your device, is never transmitted to Eviory's servers, and is automatically stripped from any Cloud Sync payload.

Cloud Sync is enabled by default to provide seamless multi-device access. By continuing to use Eviory OS with Cloud Sync active, you consent to Eviory accessing your text-based, structured JSON data (e.g., content strategies, hooks) both to power in-app AI features on your individual account and, where noted in our Privacy Policy, in aggregated form for service improvement. You can switch to strict Local-Only mode at any time in Settings; doing so stops all future syncing, and previously synced data is deleted within 90 days. Visual media assets are not accessed or analyzed by Eviory for product purposes, except for automated security or legal-compliance scanning performed by our infrastructure providers. Your personal API keys are automatically stripped before any data leaves your device.

Eviory offers monthly/annual subscriptions (Eviory Pro, Eviory Pro+) and consumable digital products (AI Credit Top-Ups). Your subscription grants you a personal, non-transferable, non-exclusive license to use the system, its AI capabilities, and the full Content Pack library available in the content store, for as long as your subscription remains active. Pro and Pro+ unlock the entire content pack catalog equally; Free tier access is limited to Lite content packs only.

This license is limited to use for a single business or brand. If you manage content, AI workflows, or client deliverables for multiple separate businesses or clients (e.g., as a social media manager, consultant, or agency), each client relationship requires either its own subscription or our Agency/White-Label plan, which is designed for multi-client use. You may not resell, redistribute, reverse-engineer, or share the OS, its source code, or its content packs with third parties.

Because Eviory offers subscription services and consumable digital products (AI Credits), our policy varies by purchase type:

• Subscriptions (Eviory Pro, Eviory Pro+): You may cancel your subscription at any time via your billing dashboard. Cancellations take effect at the end of your current billing cycle. We do not offer prorated refunds for partially used billing periods.
• Consumables (AI Credits): Due to the nature of API usage and instantaneous provisioning, all purchases of AI Credit top-ups are final. We do not offer refunds once credits have been added to your account.
• Frozen Credits on Cancellation: Upon cancellation or expiration of a Pro or Pro+ subscription, any remaining AI Credits are frozen and inaccessible for use with premium AI features. Standard Pro subscriptions do not receive rollover. If you reactivate a Pro+ subscription, 50% of your frozen credit balance is added to your new monthly allocation as a one-time rollover; standard monthly rollover then applies going forward. Accumulated credit balances are structurally capped at 2x your active plan's monthly credit allocation and cannot exceed this limit regardless of tenure. Eviory reserves the right to modify, limit the duration of, or discontinue the frozen-credit policy at its discretion, with notice to affected subscribers.

All templates, content packs, source code, the AI orchestrator, and underlying systems provided through Eviory OS are the intellectual property of Eviory. Your subscription grants you a license to use them as described in Section 5, not ownership of them. Unauthorized reproduction, redistribution, or reverse-engineering of these materials is strictly prohibited.

Content you create using Eviory OS, such as captions, designs, and strategies generated for your own business, belongs to you. You are free to use, publish, and monetize your own output without restriction.

Results from using our content strategy systems and AI orchestrator may vary. We do not guarantee specific revenue outcomes, follower growth, or engagement metrics. Success depends significantly on your execution, your niche, and current market conditions. AI-generated content (including captions, strategies, and designs) may contain errors or inaccuracies; you are responsible for reviewing and approving all AI-generated content before publishing or using it for your business.

We reserve the right to update these Terms at any time. Minor changes will be posted on this page with an updated date; material changes affecting your subscription benefits, pricing, or AI credit policies will be communicated via email or in-app notice at least 14 days before taking effect. Your continued use of Eviory OS after changes take effect constitutes acceptance of the updated Terms.
